Background:
Litigation arising from the prohibition against terminating established commercial relationships concerns full court proceedings or summary proceedings. These provisions pose difficulties in application, both as regards the conditions of implementation and its effects, and, especially, the evolution of the loss to be compensated. In addition, there is the question of the weight to be accorded to contractual stipulations, whether jurisdiction clauses or provisions concerning the termination itself, among others. In addition, even though Article L.442-6-1-5 of the French Commercial Code is not applicable, it exerts an influence on litigation regarding sudden termination as seen in the light of the common law of obligations.
