The civil trial is at the heart of new issues: the strengthened role of the judge and higher demands of quality. The objective of this session is to present in a complete way the procedural aspects of civil litigation, including those of community and European law, and to look in depth at the difficulties that can arise in applying them.
Through concrete examples, this session will look at the major themes of civil trials, the requirements for a fair trial, the role of the judge, the administration of evidence, the new powers of the judge, electronic communication, contracts and other procedural agreements, presiding at hearings, case management and the quality of the judgments.
In each case, the specificities of oral procedure will be brought out.
Draft reforms will also be discussed.
