As in other EU Member States, in Luxembourg both judges (magistrats du siege) and public prosecutors (magistrats du parquet) are members of the same professional body.
The court system is made up of three "Justices de Paix", two "Tribunaux d'Arrondissement", one "Cour d'Appel" and one "Cour de Cassation". There is one "Tribunal administratif" and one "Cour administrative" for disputes concerning administrative matters.
The control of the constitutionality of the laws is ensured by the "Cour constitutionnelle".
The responsibility for the initial and the ongoing training of judges and public prosecutors lies with the Ministry of Justice.
In practical terms, a commission composed of senior magistrates and senior civil servants is in charge of all aspects of the training of judges and prosecutors. Because Luxembourg does not have a specific institution or school for the training of its judges and prosecutors, the Ministry of Justice has reached an agreement with the French Ecole Nationale de la Magistrature located in Bordeaux.
Under the terms of this agreement the "attaches de justice" (future judges and prosecutors) attend a theoretical training at the E.N.M. Following this, the "attaches de justice" have to attend in Luxembourg a practical training in the courts, with the prosecutor's office, police services, penitentiary services, etc.
As part of the ongoing training, judges and prosecutors attend courses organised by the French E.N.M. and the German Richterakademie.
